This appeal is directed against the impugned final judgment and order dated 4.1.2007 passed by the Guwahati High Court in MAC Appeal no. 30 of 2003 whereby the High Court held that the appellant herein is entitled to a sum of Rs. 1,94,400/ as compensation for the death of Purnya’s husband Dhanbahadur Chhetry. Purnya Kala Devi is appellant of the case. His husband was run over by a bus bearing registration no- AMZ- 6858, and died, the accident having taken place due to rash and negligent driving of the offending vehicles by its driver. The claimaist was sought for the compensation. Though this claim for compensation was made not only against Abdul Salam who was registered owner of the said vehicle, but also against one Jalil Haque, who is said to have purchased the said bus. Mr. Abdul Salam appeared in the claim procceding and filed his written statement wherein he submitted, inter alia, that at the time of the accident, the vehicle was under requisition by the State Government.
